I watched Rick Steves Europe last night and he was in Sicily. He was drinking and mentioned not to drink and drive because the BAC there was low and the penalties high!

Carol, an officer can tell if a person is under the influence just by looking at the person and observing their actions and speech. They also often do the eye-pencil test which sober people will pass. If he blew a .02, then it's really strange that he got arrested. The judge will throw this case out for sure. Doesn't matter if he couldn't do the field sobriety test or not, if he only blew .02, he'll be fine. The affect alcohol has on us can be influenced by our fatigue levels and what we ate recently. Keep us posted on his court case. I honestly can't see the judge supporting this charge. It was a rookie cop who pulled him over and it was near the end of shift and in the words of our lawyer" The officer had a quota to fill." He was originally pulled over because the tail light was out. He was never given a ticket for that. My husband was very cooperative. He did everything asked of him. The office looked in the trunk and found an unopened 6 pack of Heinekin and that is what led to the breathalizer and sobriety test. Searching the car, to me goes under unlawful search and seizure since all he was pulled up for was a tail light being out. When I picked my husband up at the police station about an hour later he appeared to be sober, he wasn't staggering his speech was normal and I couldn't even smell beer on him. The police report says nothing about him weaving or anything else that would have caused him to be pulled over under suspicion of DWI.
